Terms and Conditions of Sale

O & P Birmingham is pleased to accept orders subject to the Terms and Conditions of sale as stated below. Your use of the O & P Birmingham website ( and purchase of the products (products) on it means that you agree to these terms and conditions (terms). No variation of these conditions shall be binding unless agreed by letter signed by an Authorised Representative of O & P Birmingham. Please read the terms carefully before placing your order. We would advise you to retain a copy of them for your future reference.


Product Prices

We always try to make sure that the prices on are accurate but occasionally errors or price changes may occur. We reserve the right at any time to revise prices to account for any increases in costs including the increase or imposition of any duty, tax, levy or exchange rate variation. We will take all reasonable steps to notify you of any relevant revision of prices before processing your order.


Cancellation of Orders

Orders can only be cancelled if the item has not been despatched. Please e-mail us as soon as possible if you decide to cancel an order, so that we can cancel despatch. Your credit card will be immediately credited, when a cancelled item has not been despatched.


If the item has been despatched, you will be responsible for paying the postage costs for returning the item(s) to us. When returning a cancelled order, you must send via a courier (preferably, Royal Mail) that provides tracking, and provide us with the tracking number. If the item is lost or destroyed in transit, you will be charged for the item. Therefore it is recommended that you purchase insurance from the courier, so you can be reimbursed for an item if it is lost or destroyed in transit.


For items cancelled after they are despatched, your account will not be credited, until we receive the returned item.


Availability of Website

We try and offer you the best service we can. But we cannot promise that all our products and services will meet your requirements and we cannot guarantee that this website will be fault free. If you find a fault, please let us know by contacting


One to One

‘One to One’ is a non-chargeable service offered by O & P Birmingham.

FaceTime and Skype sessions are by appointment only and will last for 30 minutes or 1 hour. Customers requiring additional time for an appointment must request this at the time of making the booking. If an appointment appears to be on course to overrun, it is at the personal shopper’s discretion as to whether additional time can be given or a new appointment is required.

‘One to One’ is available from Monday to Friday between 11am - 6pm GMT/BST.

The personal shopper will decide whether a customer using WhatsApp requires a booked appointment dependent on the customer’s needs. In the event an appointment is not required, customers should expect to receive a response to their questions within 1 working day.

Whilst ‘One to One’ aims to allow customers to view products that are available in store, some items will remain exclusive to in-store customers only.

Products can be purchased in full during an appointment. Products can also be reserved for customers with a non-refundable deposit (50% of the final price). All payments will be taken by card and over the phone. Products purchased through ‘ONE TO ONE’ are non-refundable.

Delivery charges are additional to the final cost of the products purchased. Such charges will be dependent on the type delivery service required, delivery address and the weight of the order.

In the event that the customer or the personal shopper experiences technological failures, we endeavour to resume the communication once all connectivity issues have been resolved.



We aim to deal with any complaints in a fair, confidential, swift and effective way. They should be directed via the secure 'Contact Us' link found at the top of each page and include full contact details in addition to your e-mail address together with order number where appropriate.


Liabilities and Responsibilities

O & P Birmingham total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, and restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods.


Nothing in these conditions excludes or limits the liability of O & P Birmingham for death or personal injury caused by the O & P Birmingham’s negligence or fraudulent misrepresentation.


The limitation on any exclusion from liability contained in these Conditions shall be subject to the provisions of section 2(1) of the Unfair Contract Terms Act 1977.


O & P Birmingham will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communications outages, fire, flood, war or act of God.


Interpretation and Jurisdiction

These terms and conditions only cover the O & P Birmingham website. Any other websites which you link to from this website are governed by their own terms and conditions. We accept no responsibility or liability for web sites that are not under our control. We are required by law to inform you that sales can only be concluded in English. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and each party agrees irrevocably to submit to the exclusive jurisdiction of the courts of England and Wales.


Privacy Policy

O & P Birmingham will occasionally update its privacy statement to reflect company and customer feedback. When O & P Birmingham posts changes to this statement, you will see the word "Updated" next to the link on the O & P Birmingham home page. O & P Birmingham encourages you to periodically review this page to be informed of how we are protecting your information. If you have questions or concerns about policy changes, you should first contact the O & P Birmingham customer service department at


O & P Birmingham may request personal information, including your name, shipping address, telephone number, e-mail address, billing address, credit card number, and expiry date. O & P Birmingham collects that information in order to:


  • Process an order;
  • Verify your identity for payment authorisation;
  • Contact you regarding your order status;
  • Ship your order to you;
  • Send you news from O & P Birmingham (if you request);
  • Provide you with an excellent shopping experience.


Once O & P Birmingham gathers your name and address, this information will then be transferred to your credit card company, if applicable, for confirmation to complete your purchase. Your shipping information may also be supplied to a third-party fulfilment centre, but your name and address will not be used for any other purpose than delivery of your order. Your name and address will not be sold to mailing-list firms.
